HC quashes ACB’s FIR against cop

JAMMU, May 1: High Court has quashed FIR registered by Anti-Corruption Bureau against Police cop namely Nazir Hussain Shah with the observations that two FIRs cannot be lodged for one offence.
According to the Anti-Corruption Bureau, a formal case against constable Nazir Hussain Shah then posted at Police Station Mandi in Poonch district was registered on the basis of complaint lodged by one Mohd Aslam alleging that Nazir Hussain Shah had demanded and accepted Rs 75,000 from him for getting his son recruited as constable in Police Department.
The enquiry conducted reveals that said constable Nazir Hussain Shah had taken bribe amount of Rs.75,000/- from the complainant on the pretext of getting his son appointed in the Police Department.
After hearing Advocate Ch Nayaz Ahmed Naz for the petitioner whereas Advocate Sanchit Verma vice Deputy AG Raman Sharma for the State, Justice Sanjay Kumar Gupta observed, “two FIRs cannot be lodged by different agencies for the same occurrence as Police Station Mandi has already lodged an FIR on the same facts and circumstances “, adding “the FIR lodged by the Vigilance Organization Jammu is not maintainable as such the same is quashed”.
However, High Court made it clear that Police Station Mandi can add any other offence in FIR No.48/2018.
