CBI to proceed for attachment of properties of corrupt bureaucrats

NEW DELHI, May 10: The Government has recently issued instructions to grant “quick” authorisation to CBI to proceed with the process of attachment of properties of corrupt bureaucrats who have retired, the Rajya Sabha was informed today.

“The recent instructions would facilitate quick decision making in respect of requests received from the CBI for grant of authorisation for filing applications for attachment of property of retired corrupt bureaucrats,” Minister of State for Personnel V Narayanasamy said during Question Hour.

He was referring to a January 19, 2012 clarification of the Department of Personnel and Training (DoPT) to all ministries and departments regarding attachment of property of corrupt bureaucrats.

In May 2009, the DoPT had issued an Office Memorandum (OM) stating that the authorisation under the Criminal Law (Amendment) Ordinance, 1944, for attachment of property would also have to be given by such authority who would be competent to accord sanction under Prevention of Corruption Act, 1988.

Narayanasamy said the OM was general and did not make any specific reference to the retired public servants. This led to difficulties in issuing authorisation of the Central Government for attachment/confiscation of property of corrupt retired officers, he said.

“Therefore, after consultations with the Ministry of Law and Justice, clarifications were issued vide OM dated 19.1.2012 as to who would be the competent authority to issue authorisation of the Central Government in such cases,” he said. (PTI)
