SRINAGAR, Sept 19: As the Government has accepted the enquiry conducted into the case of former Director Sher-e-Kashmir Institute of Medical Sciences (SKIMS), the High Court today directed the Chief Secretary of the State to place the matter before the governing body for its decision.
It is Secretary to General Administration Department who in his communication has said the enquiry conducted in the case of Dr A G Ahanger (former Director SKIMS) by the Financial Commissioner Health and Medical Education Department has been accepted by the competent authority and the same will be placed before the governing body of SKIMS for follow up action in the case as the Governing body is the appointing authority for the post of Director.
Justice Ali Mohammad Magrey, after this information said, the Chief Secretary has with full strength implemented the order of the court and is further expected to place the matter before the governing body as early as possible and not later than two weeks for decision. “Outcome of the decision of the governing body shall be intimated to the court by next date of hearing”, Court directed.
The court was hearing the plea filed by the then director SKIMS Dr A G Ahanger against his ouster from the post of Director after sting operation against some doctors of SKIMS divulging their involvement in private practice.
The court during the proceeding of the matter has been apprised about the acceptance of the enquiry report which is to be followed by the follow-up action by the governing body of the SKIMS.
Dr Ahanger, who was present in the court, submitted that the court in order to do substantial justice may seek response of the follow-up action of the governing body on the strength of the enquiry as conveyed by the Government.
Javed Iqbal (Sr. AAG) submitted before the court that a reasonable time requires for taking follow-up action by the governing body of the SKIMS. Court on thoughtful consideration and keeping in view of the anxiety of the petitioner Ahanger deemed it appropriate to grant two weeks time to Government to place the matter before the governing body for decision.
