10 yrs imprisonment awarded in kidnapping, rape case

UDHAMPUR, Nov 1 : Udhampur court today sentenced a man to 10 years imprisonment for kidnapping and raping a local girl under Section 363/376 RPC.
Principal District and Sessions Judge Udhampur Mohan Lal Manhas awarded the 10 years sentence to one Mohamed Farooq son of Shaffi Mohamed resident of village Thathi Kotli Jijan, Tehsil Udhampur after convicting him under Section 363/376 RPC for kidnapping and raping a minor local girl .
Brief facts of the prosecution case is that on the information of father of victim to police station Rehmbal that her 16 years old daughter had been kidnapped on 02.06.2016 from home in Jib Udhampur when parents were out of station . On the basis of this information, Police Station Rehmbal registered a case under Section 363 RPC and started investigation in this regard.
During the investigation, the girl was recovered from Bharatpur, Rajasthan .On the basis of statement of witnesses and victim girl, accused was booked under Section 363/376/201/343 RPc and later challan was presented in Session court Udhampur 09.12.2016.
Pubic Prosecutor Navneet Gupta appeared for the state while Advocate Shamim Ahmed appeared for accused. Prosecution examined 13 witnesses out of total 18.
Awarding the Judgment, the Judge said that 02.06.2016 was the day on which prosecutrix suffered unfathomable physical agony and traumatic ignominy that one can conceive at the hands of accused ,the libidinousness and lustful designs of accused crossed all boundaries of indecency as he enticed the minor prosecutix and took her away from the lawful guardianship of her parents towards Punjab and Rajasthan where she was raped by accused unmindful of the shattering mental trauma the later suffered.
“Such types of offences are to be dealt with severity and with iron hands showing leniency in such matters would be really a case of misplaced sympathy .The act of accused are not only shocking but outrageous in contours,” he added.
As such accused Mohamed Farooq has been held guilty of commission of offence under section 366/376 RPC is therefore convicted and sentenced to undergo rigorous imprisonment of 3 years and fine of Rs 10,000/ under Section 363 RPC and Rigorous Imprisonment of 10 years with fine of rupees Rs 20,000/ for offence under Section 376(2)(1) RPC
And in default of fines on both counts, accused will undergo further rigorous imprisonment for a period of six months. However all the sentences shall run concurrently. The Judgment further said that amount of fine imposed upon accused if paid /deposited by him shall be paid to the victim for her rehabilitation. An amount of Rs. one lakh lac as compensation to victim/prosecutrix was also recommended to the State Legal Services Authority for consideration and grant of the same.
