NEW DELHI, Nov 14: Union Minister of State (Independent Charge) Development of North Eastern Region (DoNER), MoS PMO, Personnel, Public Grievances & Pensions, Atomic Energy and Space, Dr Jitendra Singh said here today that Article 370 was misused to allow girl-child marriage and infact, it was used to violate the human rights of the children and students in general.
In an interaction with a group of students from Delhi University, on the occasion of Children’s Day today, Dr Jitendra Singh said, those who have been the biggest votaries of Article 370 were actually the biggest abusers of the same Article and they used it, by their own convenience, whenever it suited them from time to time. He said, nowhere in the world, any section of the society would object to Child Marriage Act being implemented but it was not allowed in Jammu, Kashmir and Ladakh, simply because the powers-that-be intended to appease a certain section of people or a certain community or a certain vote bank. This, thus, left the option to allow a man entering into wedlock with a child girl-child without being held guilty for this, he added.
Similarly, the Dowry Act was not implemented in Jammu and Kashmir and Ladakh, said Dr Jitendra Singh and added that this led to the dominance of patriarchal culture. About 35-A, he said, everybody is well aware of how the daughters were deprived of their family property rights.
With the abrogation of Article 370 and new administrative arrangement having been introduced, Dr Jitendra Singh said, the Triple Talaq Law enacted by the Modi Government also becomes applicable in Jammu & Kashmir and Ladakh which would have, in all probability, been resisted by the erstwhile Governments. As far as youth and students are concerned, he said, the Right to Education has also become applicable to Jammu & Kashmir and Ladakh now.
Not only this, said Dr Jitendra Singh, Article 370, instead of promoting education, deprived youth of quality education in higher institutions and led to their exodus because of lack of appropriate faculty. On the contrary, he said, the psychological isolation, resulting from this Constitutional aberration, drove the youth away from their studies and pushed them to take up arms and terrorism.
