JAMMU, Mar 26: Taking a serious note of illegal engagements in various departments, the State Government today ordered immediate discontinuation of the persons engaged in violation of Jammu and Kashmir Civil Services (Special Provision Act), 2010 and SRO-64.
A formal order in this regard was issued today by the GAD asking all the Administrative Secretaries also to identity and charge-sheet the officers responsible for making illegal appointments. Besides discontinuing the illegal engagements, the Administrative Secretaries have also been directed to forward copies of the disengagement orders to GAD within a fortnight.
However, the GAD circular further says, the engagements made in accordance with Government order number 239-F of 2005, dated 29-11-2005, may be revisited by the concerned departments and kept at the bare minimum requirement.
The illegal engagements came into light while collecting details from various departments for replying to certain questions, raised in the State Legislature, observed the GAD Circular.
Pertinent to mention that the Jammu Kashmir Civil Services (Special Provision Act), 2010, provides for the regularization of contractual/consolidated and adhoc employees, engaged before the enactment of the said Act. With a few exceptions like PSUs, Personal Sections of Ministers etc, all engagements on contractual/consolidated and adhoc basis have been banned under this Act.
A blanket ban was also imposed on the engagement of DRWs while devising a policy for the regularization of daily rated workers vide SRO 64 of 1994. However, in view of the difficulties faced by some department, Agriculture, PWD, PHE, Irrigation, Flood Control and PDD were permitted to engage need based workers vide Government order number 239-F of 2005, dated 29-11-2005.
