RAMBAN, Feb 7: Principal District and Sessions Judge Kishore Kumar has rejected the bail application of a narcotics smuggler arrested by Ramsu Police.
The bail application moved by advocate Younus Ahmed on behalf of alleged narcotics smuggler Manzoor Ahmed Lone, son of Gh. Rasool Lone, a resident of Damal Hanjpora District Kulgam was rejected by Principal District and Sessions Judge, Special Judge NDPS Court Ramban, Kishore Kumar.
While objecting to grant bail to the alleged narcotics smuggler, Chief Prosecuting Officer Advocate Ishtyaq Bhatti vehemently and forcefully argued before the court that granting bail to this smuggler will sent wrong signal to society. He argued that offences committed by the accused are heinous and against the society.
According to prosecution story, the accused Manzoor Ahmed was found carrying 25 kilograms poppy straw and was booked under FIR number 112 under Section 8/15 NDPS Act by Police Station Ramsu on 07-12-2019.
Principal District and Sessions Judge Kishore Kumar after hearing both the sides said that the applicant cannot admitted to bail in this heinous and anti social crime. “It is true that the grant of bail is a matter of judicial discretion however the discretion cannot be exercised too loosely particularly in heinous offences of serious nature of grave concern”, he added.
“The bail application filed by the petitioners cannot be allowed at this stage as the petitioner is involved in a very serious offence which is non bailable. No doubt the court grants bail in the non bailable offences but keeping into consideration the nature and seriousness of the offences allegedly committed by the accused, I am of the view that no good ground is made out by the petitioner for enlarging him”, he said while rejected the bail application.
