PIL regarding drug abuse in J&K

JAMMU, Feb 18: In a Public Interest Litigation (PIL) filed by Atharv Mahajan, a student of law, highlighting the menace of drug abuse, Division Bench of High Court comprising Chief Justice Gita Mittal and Justice Rajesh Bindal today took serious note of non-compliance of the directions issued from time to time and directed the Special Secretary, Home Department to remain present on next date of hearing.
“The directions with regard to Leh and Kargil made by an order dated 18th April, 2018 have not been complied with”, the DB observed, adding “let a copy of the that be sent to the Chief Secretary, UT of Ladakh to ensure compliance and report”. The DB further directed Chief Secretary, UT of Ladakh to ensure that the UT is properly represented before the court the next date of hearing.
DB further directed Principal District and Sessions Judges to send a report regarding registration of cases under the Narcotic Drugs and Psychotropic Substances (NDPS) Act, wherein challans have been filed without enclosing report from the Forensic Science Laboratory (FSL) since 2018 till date.
It is worthwhile to mention here that Division Bench on April, 2018 had directed the Principal Secretary to Government, Home Department, J&K, to file a status report indicating whether there is any Forensic Science Laboratory (FSL) specifically meant for Jammu, Srinagar and Ladakh Province for narcotics and if not, what are the steps taken to establish the same.
