12 years RI awarded in rape case

JAMMU, Feb 28: Principal Sessions Judge Rajouri Jaffer Hussain Beigh today awarded 12 years rigorous imprisonment to Army jawan Ravinder Kumar alias Sonu, son of Rattan Singh of Rajouri, who was facing trial in rape and kidnapping with minor.
After hearing both the sides, the court observed, “as far as the imposition of sentence upon the accused is concerned, the nature of the offence, the circumstances of its commission, the age and the character of the offender, injury to individual or the society, effect of the punishment on the offender, eye to correction and reformation of the offender, are some amongst many other factors which would be ordinarily taken into consideration”.
“The main offence under Section 376(1) RPC committed by the accused is punishable with imprisonment of either description for a term which shall not be less than seven years but which may be for life or for a term which may extend to ten years, and shall also be liable to fine. The trial in this case has taken more than a decade and the accused is army person and has his own family”, the court further observed.
Accordingly, court awarded rigorous imprisonment for seven years for the commission of offence under Section 376(1) RPC, five years imprisonment for the commission of offence under Section 363 RPC. The court, however, clarified that both the sentences of rigorous imprisonment shall run concurrently.
