JAMMU, Mar 12: Division Bench of the High Court comprising Chief Justice Gita Mittal and First Puisne Judge Justice Rajesh Bindal today reiterated its earlier directions issued on March, 4, 2020 by directing 1st Additional Sessions Judge (Special Judge Anti-Corruption), Baramulla to file the date-wise summary of proceedings in a tabular form carried out since the filing of the challan–September, 25, 2012 in case FIR relating to infamous Gulmarg land scam.
After hearing Advocate Sheikh Shakeel Ahmed with Advocates Rahul Raina, Supriya Chouhan and Mohd Zulkarnain Chowdhary appearing for the petitioner, the Division Bench also directed Anti-Corruption Bureau, Jammu as well as Anti-Corruption Bureau, Kashmir to place before the court the current status of 17 FIRs registered in connection with the Roshni land scam indicating therein the stage of investigation.
The Division Bench also issued notices in an application filed by the petitioner seeking quashment of Order No.DCJ/HQA/ROSHNI/08/676-77 dated June 9, 2008 whereby the then District Collector Jammu Hirdesh Kumar Singh had conferred ownership rights under Roshni with regard to land measuring 05 Kanals 02 Marlas comprised in Khasra No.781 situated at village Deeli (Marble Market), Jammu in favour of a high profile businessman of Jammu and also seeking quashment of No Objection Certificate bearing No.VC/PS/ 2013/631-32 dated January 23, 2013 issued by the then Vice-Chairperson JDA Sarita Chouhan.
The notices were accepted by Senior AAG S S Nanda on behalf of Commissioner Secretary Revenue Department, Commissioner Secretary Housing and Urban Development Department, Divisional Commissioner Jammu, Deputy Commissioner Jammu whereas Advocate Adarsh Sharma accepted the notice on behalf of Jammu Development Authority.
Both of them were directed to file their response before the adjourned date of hearing. In the fresh application (C.M. No.1972/2020) the petitioner has sought directions to the Anti-Corruption Bureau to finalize the investigation in case FIR No.6/2014 P/S VOJ and case FIR No.6/2015 P/S VOJ wherein Sudanshu Pandey, the then Divisional Commissioner Jammu, Hirdesh Kumar Singh, the then Deputy Commissioner Jammu, Sarita Chouhan, the then VC JDA and several middle rung officers including the beneficiary of the Roshni are figuring as accused.
Division Bench also directed Advocate Adarsh Sharma to file updated status report with regard to the utilization plan of the JDA land which has been retrieved from land mafia.
