SRINAGAR, Mar 17: The High Court today closed the Public Interest Litigation (PIL) regarding the fate of cases which were pending before the State Information Commission (SIC) before coming into force of the J&K Reorganization Act 2019 and directed the Government to evolve the mechanism for dealing with these cases.
The petition was filed in public interest, revolves round the subject of repealing of the Jammu and Kashmir Right to Information Act, 2009 in terms of the Jammu and Kashmir Reorganization Act, 2019 and the fate of the cases pending before the State Information Commission which stands abolished on the application of the Jammu and Kashmir Reorganization Act, 2019.
The grievance espoused in the petition was that as many as 364 cases, including 131 complaints and 233 appeals, were pending before the State Information Commission and that nobody knows as to what will happen to these cases since the Government has not issued any notification or order in this behalf suggesting the course to be adopted for dealing with all these matters after J&K Reorganization Act 2019 came into being on October 31 last year.
Senior Additional Advocate General, informed the concerned authorities in the Government of Union Territory of Jammu and Kashmir is in the process of framing rules with regard to the subject matter involved in the instant petition and that the Government will evolve a mechanism for dealing with the cases pending before the erstwhile State Information Commission as expeditiously as possible.
“In view of the statement made by the Senior Additional Advocate General, we feel that no useful purpose can be achieved by keeping the instant petition pending and that same can be closed by directing the Government of Union Territory of Jammu and Kashmir to do the needful with reference to the grievance projected by the petitioners, as undertaken by the learned Senior Additional Advocate General. We order accordingly. PIL disposed of,” Division Bench of Justice Ali Mohammad Magrey and Justice D S Thakur concluded.
