Disclose name of encroachers: DB to DC Kathua

JAMMU, Apr 4: Division Bench of State High Court comprising Justice Muzaffar Hussain Attar and Justice D S Thakur today directed the Deputy Commissioner Kathua to file an affidavit indicating the names of the persons from whom 92.6 kanal State land has been retrieved in village Krandi Khurd of Hiranagar tehsil. The DB has also clubbed the petition filed by RB Educational Trust, Kathua filed through its Trustee Kanta Andotra, wife of Congress MP Ch Lal Singh with the instant Public Interest Litigation.
When the PIL regarding land-grabbing came up for hearing, the counsels for the petitioners drew the attention of the Court towards the Action Taken Report filed by the General Administration Department mentioning that 92.6 kanal State land has been retrieved in village Krandi Khurd of Hiranagar tehsil.
“In the ATR the GAD has not mentioned as to from whom the land has been retrieved”, the counsels for the PIL said, adding “the GAD has also preferred complete silence over the approach road mentioned in the recommendation of the Commissioner of Vigilance”. They also submitted that the authorities have not reached any case against the illegal occupants of the State land.
After hearing both the sides, the DB directed Deputy Commissioner Kathua to file an affidavit within two weeks and mention the names of the encroachers from whom the land has been retrieved. The DB also clubbed the petition filed by RB Educational Trust, Kathua through Trustee Kanta Andotra challenging the order dated March 5, 2013 passed by the Deputy Commissioner Kathua.
