NEW DELHI, Apr 5: Two of the total four accused in the December 16 gangrape case today moved the Delhi High Court against the special court order dismissing their plea for trial to be held on alternate days instead of day-to-day basis.
The two accused challenged the March 28 order of the special court in which it had dismissed their plea saying that such pleas are made only to delay the proceedings.
The accused had filed an application before the special court where trial is going on that the trial be conducted on alternate days instead of day-to-day basis.
The trial court dismissed their petition saying that the accused were trying to delay the proceedings.
The two accused Mukesh and Akshay approached the HC saying that their prayer that trial be allowed to be conducted on alternate days whenever the counsel of the accused needs to seek some instructions from his clients.
M L Sharma, lawyer appearing on behalf of both accused also sought quashing of the First Information Report (FIR) and subsequent proceedings on the grounds that police had manipulated the case as the original complaint was silent about the names of accused persons.
The accused alleged that the police has not provided them the Hindi translation of the FIR which is a mandatory requirement before commencing of any trial.
The lawyer alleged that all evidence has been procured by the police through torture and cohesion to implicate the accused persons as they are poor and have no say in the society, Sharma alleged.
The trial in the gangrape case in which a 23-year-old paramedical student was gangraped in a moving bus on December 16.
The trial is going on in a fast track court especially set up to try the sensational case which had rocked the conscious of the nation as well as posed certain questions about safety of women in the Capital.
The trial is going on day to day basis and after the HC intervention media has been allowed to report the case.
The HC lifted the media gag on reporting of this particular case but cautioned mediapersons to safeguard the victim’s rights who had succumbed to her injuries in a Singapore hospital where she was taken by the Delhi government for treatment. (UNI)
