No quota for RBA, OSC; STs get 45 pc reservation, SCs 1 pc

JAMMU, Apr 29: The Union Territory of Ladakh has adopted a new roster for reservation in recruitment with significant changes in the quota for different categories by affecting amendments in the Jammu and Kashmir Reservation Rules, 2005.
In the newly adopted roster for reservation, the quota for Scheduled Castes in Ladakh UT has been slashed from 8 percent to one percent while for the Scheduled Tribes, the reservation quota has been increased from 10 percent to 45 percent.
Further, the reservation for residents of backward areas as well as for the Other Social Castes (weak and under privileged classes) has been completely abolished in Ladakh UT whereas the respective quota for residents of areas adjoining Actual Line of Control (ALC) and physically challenged persons under horizontal reservation, has been increased from 3 percent to 4 percent for the both.
The significant changes in the reservation quota for different categories have been made by the Administration of Union Territory of Ladakh, Social Welfare Department, in exercise of the powers conferred by section 23 of the Jammu and Kashmir Reservation Act 2004, as extended to the UT of Ladakh by the Jammu and Kashmir Re-organization Act, and in accordance with the Rights of Persons with Disabilities Act, 2016.
Making amendments in the Jammu and Kashmir Reservation Rules, 2005, the Administration of Ladakh UT has substituted 8 percent with one percent in clause (a), Rule-4, which envisages reservation in recruitment for the Scheduled Castes.
In clause (b), Rule-4, 10 percent has been substituted by 45 percent, which means 45 percent of available vacancies in the UT shall be reserved for Scheduled Tribes, who constitute maximum population of Ladakh.
Similarly, the reservation quota for residents of areas adjoining ALC and Physically Challenged Persons, under horizontal reservation, have been increased by substituting 3 percent with 4 percent in sub-clause (ii) of clause (b) in Rule-4 and clause (e) in Rule-4, respectively.
The reservation shall be available for physically challenged persons for services and posts specified in Section 34 of the Rights to Persons with Disability Act, 2016. One percent added reservation shall be given to persons with autism, intellectual disability, specific learning disability or mental illness. One percent quota, under horizontal reservation, has been kept each for persons with blindness or low vision, deaf and hard of hearing and locomotor disability or cerebral palsy.
However, the reservation for Other Social Castes and residents of backward areas has been completely abolished in the Ladakh UT by substituting `Nil’ for 2 percent and 20 percent in sub-clause (i) and sub-clause (iii), respectively of clause (c), Rule-4 of J&K Reservation Rules,2005.
Hence, there will be no reservation in the UT Ladakh for the residents of backward areas, who were having 20 percent recruitment quota in the erstwhile Jammu and Kashmir State. Similarly, the Other Social Castes (socially and educationally backward classes, other than SCs and STs), who were having 2 percent reservation in erstwhile State of J&K, will have no recruitment quota in the UT of Ladakh.
However, no change has been made in the quota for Ex-servicemen, who will continue to enjoy 6 percent horizontal reservation in the Ladakh Union Territory.
With these amendments in the Jammu and Kashmir Reservation Rules, 2005 and changes in the quotas for different categories, the Social Welfare Department of Ladakh UT has notified a roster of 100 vacancies in respect of each service, class, category and grade in the services and posts in the Union Territory.
