JAMMU, May 14: Special Judge CBI Rajesh Sekri today rejected bail application of Hilal Rather, son of ex-Finance Minister Abdul Rahim Rather, who is facing trial in the much publicized J&K Bank loan scam.
“The offences committed by the accused, in instant case, are highly deleterious having societal ramification”, the court said, adding “there is cogent evidence available on record regarding culpability of the accused”.
“The material collected by the investigating agency, overwhelmingly and cogently point towards prima facie involvement of the petitioner in the economic offences of high magnitude. Strong insinuations emerge from the material that he not only convincingly diverted the loan amount but entered into deep rooted criminal conspiracy with co-accused to misappropriate the same for his personal gains”, the court further said.
The Special Judge said, “his culpability, in the commission of offence under Section 409 RPC is punishable with imprisonment which may extend to life. There is every apprehension, as such, that bail if granted to him may no longer render the case conducive to trial, which is yet to commence”, adding “release of petitioner on bail at this juncture, in my opinion, is likely to thwart the whole process of trial”.
With these observations, court rejected the bail application.
