Bail plea of two accused in murder case rejected

JAMMU, Apr 13: Principal Sessions Judge Jammu, Kartar Singh has rejected the bail application of Bodh Raj and Bachan Lal, who have been facing trial in murder case. However, Parkasho Devi, wife of Bodh Raj was granted bail.
According to the police case, on July 5, 2012, the petitioners along with other accused trespassed in the land of deceased Krishan Lal and started ploughing it with a tractor. When the deceased protested, the petitioners and other accused caught hold of him with an intention to commit his murder.
The petitioner Bodh Raj sprinkled kerosene oil on him and the accused Om Parkash lit match stick and set him ablaze as a result of which he sustained injuries. Later, Krishan Lal succumbed to injuries in the hospital.
After hearing both sides and referring various judgments of the Apex Court, Principal Sessions Judge observed, “the prosecution case is based on circumstantial as well as direct evidence and the circumstantial evidence is yet to be adduced. The deceased is also stated to have made a dying declaration which is yet to be proved”, adding “nothing can be said at this stage about the prima-facie case against the accused/petitioners because the evidence has not been adduced by the prosecution”.
With these observations, the Court rejected the bail application of Bodh Raj and Bachan Lal. However, the Court granted bail to Parkasho Devi.
