Accused acquitted of rape, abduction charges

JAMMU, Feb 9: Principal Sessions Judge Rajouri R N Watal has acquitted four accused of the charges of abduction and rape of a girl as prosecution miserably failed to prove the guilt beyond any reasonable doubt.
As per the prosecution case, the accused Mohd Shabir, Mohd Shakeel, Mohd Rafiq in conspiracy with Hameeda Begum deceitfully abducted the prosecutrix on April 2, 2012 under the pretext of visiting Soda Pani Shrine from Kokernaka and took her to Jammu, Rajasthan and Punjab where Abdul Rehman committed rape with her forcible under threat to her life.
After completion of investigation into the case registered at Police Station Kandi challan was presented in the court of law. After hearing counsel for the accused and Public Prosecutor, the Principal Sessions Judge Rajouri observed, “prosecution has miserably failed to prove by cogent and clinching evidence the alleged missing of Prosecutrix, her abduction to get her forcefully married with accused Abdul Rahman”.
“Prosecution has further failed to prove alleged abduction of the prosecutrix by the accused on the pretext to visit the shrine at Soda Pani for darshan, the alleged taking of the prosecutrix near Mandi Gala through forest, abduction in a Maruti to Jammu, Rajasthan, Punjab and her sexual assault under threat to her life”, the court said, adding “even prosecution has failed to prove recovery of prosecutrix from Gandhi Nagar Jammu from accused Abdul Rehman and her medical examination to confirm her sexual assault”.
“I am of the considerate view that prosecution has miserably failed to prove the guilt against the accused beyond any reasonable doubt and I therefore do not hesitate in giving the benefit of doubt to the accused. The accused are therefore acquitted of charge, their bail bonds stands discharged”, Principal Sessions Judge said while dismissing the challan.
