Accused facing trial in rape case acquitted as prosecutrix turns hostile

JAMMU, Feb 25: Presiding Officer Fast Track Court Jammu, Sanjeev Gupta has acquitted one Liaqat Ali, who was facing trial in a rape case, as prosecutrix turned hostile.
After hearing Advocates AR Khan and TM Khan appearing for the accused person whereas Public Prosecutor appearing for the State, Presiding Officer Fast Track Court observed, “the accused was charged and prosecution was directed to lead the evidence and it has examined the prosecutrix, who had deposed that she knows the accused. About 2/3 years back, she along with her aunt was going to house of a Zamindar and on the way, an unknown person bearing mask, forcibly kidnapped her and took her towards forest. He and her aunt raised alarm but no one came on spot and masked person had done wrong thing with her. She has further stated that Liaqat Ali is son of her aunt and he is not the person who had done wrong with her. On this prosecution has declared the prosecutrix hostile”.
“From the perusal of the evidence, the most material witness in the case, and her medical certificate depict no evidence of a recent intercourse. There is nothing to suggest that accused had committed the offence with which he has been charged”, the Court said, adding “proceedings against the accused are truncated at this stage as the evidence of prosecutrix tendered during the trial would not prove the charge against the accused”.
With these observations, the Court dismissed the prosecution case and acquitted the accused of the charges.
