Accused fails to surrender before trial court; PDSJ issues NBW

JAMMU, Nov 12: Principal District and Sessions Judge Jammu Y P Bourney (Designated/Special Court under SC/ST (Prevention of Atrocities) Act, 1989) has issued non-bailable arrest warrant against Rajesh Singh Jasrotia, Inspector Fisheries as he failed to surrender as directed by High Court of J&K and Ladakh vide its judgment dated November 4, 2024.
The High Court had cancelled the bail granted earlier to the accused by the court of Additional Sessions Judge, Jammu in FIR No. 360/2021 of P/S Nagrota on the ground that the bail was obtained by resorting to worst form of ‘bench hunting/forum shopping’.
Instead of surrendering before the trial court—court of Principal Sessions Judge, Jammu, the accused moved an application for exemption on the ground that he has already filed an application in the High Court seeking extension of time to surrender. However, the court of Principal District and Sessions Judge, Jammu presided Y. P. Bourney in deference to the judgment of the High Court dated November 4, issued non-bailable warrants for arrest against accused Rajesh Singh Jasrotia for procuring his presence in the Court.
