Accused in rape case acquitted after 15 yrs long investigation, trial

JAMMU, Aug 13: Presiding Officer Fast Track Court Jammu, Sanjeev Gupta has acquitted Suresh Kumar of Bhandari Mohalla Kishtwar, who was facing trial in kidnapping and rape case for the last 15 years.
According to the police case, on July 16, 1998, the father of the prosecutrix appeared in the Police Station R S Pura and lodged an oral report with the allegations that her daughter along with her two friends went to the temple of  Bawe Wali Mata on July 14, 1998.
In the evening, two friends of her daughter told the complainant that prosecutrix while returning back alighted from the bus at RS Pura stand. On this, missing report was lodged. However, on July 19, 1998 complainant again approached the police and told that he came to know that her daughter had been enticed away by Suresh Kumar, who took her to some unknown place.
Later, police recovered the prosecutrix from the custody of Suresh Kumar and recorded her statement. Later, challan was presented under Section 376/366 RPC.
After going through the statement of the prosecutrix, Presiding Officer Fast Track Court observed, “the story narrated by the prosecutrix clearly points to her elopement instead of kidnapping. The prosecution has miserably failed to prove its case against the accused”.
Accordingly, the case was dismissed and the accused was acquitted of the charges leveled against him.
