Ad hoc employee can’t be replaced by another ad hoc employee : HC

JAMMU, Dec 24: Justice Alok Aradhe today held that ad hoc employee cannot be replaced by another ad hoc employee.
This observation was made in a petition filed by 18 contractual lecturers who were engaged in pursuance of advertisement notifications issued by the respondents on academic arrangement basis in the year 2015 for a period of 59 days or till the posts are filled up by the DPC / PSC or by transfer.
“All the petitioners are continuously working in their respective schools till date beyond the initial period of 59 days, which itself make it clear that the petitioners engagement in the schools is still required and they are performing up to the satisfaction of the Principals of their respective schools”, the counsels for the petitioners submitted before High Court, adding “as no regular selection has been made, the petitioners are entitled to be continued”.
After hearing Advocate Rajneesh Singh Parihar appearing for the petitioners, Justice Alok Aradhe disposed of the petition with the direction that ad hoc employee cannot be replaced by another adhoc employee. “The petitioners shall be allowed to continue on the posts in question till the regular selection on the posts held by the petitioners is made”, Justice Aradhe said.
