Advocate acquitted in murder case

POONCH, Apr 9: Principal Sessions Judge Poonch Tahir Khurshid Raina has acquitted an advocate in a murder case.
Advocate Abrar Hussain Shah, son of Alam Shah  of Mendhar and  his family members  including his father and brothers  were accused of commission of murder of a person  namely Guftar Ahmed.
Principal Sessions Judge Poonch Tahir Khurshid  Raina has concluded that the prosecution case was built on circumstantial evidence  but  all circumstances  failed to reach to this only hypothesis that murder of deceased has been committed by accused persons  only which is the essence of conviction in a case based on circumstantial evidence.
“All facts and circumstances projected by the prosecution evidence carries a ring of doubt around and the conduct of material witnesses in revealing the last seen evidence against the accused  was also proved to be unnatural”, the court said, adding “important links in the chain of evidence are missing  and investigation is full of doubts and was conducted in partisan manners and seems to be based on a created story by second investigating officer of the case”.
“Moreover FSL report and medical evidence completely negate the prosecution story. Therefore, in presence of huge lapses and contradictions benefit of doubt obviously goes in favour of the accused persons”, the court said, adding “though in this case a horrible murder of an orphan has taken place but court can’t  move with emotions but has to appreciate the intrinsic value of evidence and then has to  reach to any conclusion”.
With these observations, court acquitted all the accused persons including Advocate Abrar Hussain Shah.
