On 31st October 2019 G.C.Murmu took charge as the 1st Lieutenant Governor of Jammu and Kashmir after the formation of the new Union Territory of Jammu and Kashmir under the Jammu and Kashmir Reorganisation Act, 2019.
The present Lt. Governor of the J&K UT Girish Chandra Murmu IAS should try his level best to defuse the tangle immediately between the Lawyers and the State Government soon as the great fraternity of the Lawyers of the J&K High Court Bar Association, Jammu headed by the Advocate Abhinav Sharma and other courts in the region are on war path with the J&K UT Government as their indefinite strike entered 21st day today. Girish Chandra Murmu is an upright and straight forward person having the rich experience in Administration.
The Lawyers are continuously protesting and making the protest demonstrations in the High Court Complex in support of their demands and on the contrary the State Government is not paying any heed towards their just and genuine demands. There are many apprehensions that they would take their massive struggle in the streets of the Jammu city for the logical conclusion in the days to come. Since their demands are not being met with amicably by the State Government soon owing to which this may attain a Volcanic stage. From the reliable sources, It has been learnt that the Chief Justice of the J&K and Ladhakh UTs made it clear that the High Court will not be shifted to the site of Sidhra in near future as the Justices of the High Court are not in its favour.
Also it is pertinent to mention here that In the past many a battle with the State Governments from time to time were won by the J&K High Court Bar Association, Jammu as the Bar was led by the various very talented Chiefs. The Lawyers fraternity of the Jammu region never remained a failure and their leaders always remained as the victorious.
Due to the ongoing indefinite strike of the Lawyers in the entire Jammu region, the poor people and the litigants are facing a lot of problems as they are not being represented in the various courts for defending their pending cases for adjudication. The J&K High Court Bar Association Jammu and the Lawyers in the entire Jammu region are on indefinite strike in support of their demands for not shifting of the J&K High Court premises to Sidhara and for not giving the powers to the Revenue brigade of the Revenue officers in the state for the registration of the documents which was being done by the judicial Officers of the state such as the Sub Registrars, Munsiffs, ADMs etc. since many decades and there was no hanky panky at all and this process was going on smoothly up to the satisfaction of the needy. They are for the status quo ante on these two issues. They are fully determined to fight for their just and genuine cause to the logical conclusion.
The law of the land is very clear that one can not be the Judge of his own cause. Decentralizing the powers of the Registrations to the Revenue Officers of the UT would open a Pandora’s box as the history shows that it is the Revenue Department of the state which has created the mess in the past in the field in respect of the massive encroachments by the Goondas and Mafia brigades, issuance of the wrong FARDS, illegal mutations, wrong Jamabandis etc. etc.
By having this system of the registration , the entire UT will bear ransom. Therefore, in the interests of the UT and its people, the earlier system of the Registration of the documents should remain as it is and let the Revenue Department first set their house in order first and their revenue record be digitalized to have the total transprancy.
The Lieutenant Governor G.C. Murmu should take the immediate cognizance of the situation due to the ongoing Indefinite strike of Lawyers and defuse the tangle in the interests of the people of the J&K U.T.
