JAMMU, Oct 12: A deputation of AIBCU met with the Chief Minister, Mehbooba Mufti in open public darbar at guest house Budgam recently and apprised her about the problems being suffered by the other social cast (OSCs in the State).
They urged the Chief Minister to implement the 27% reservation as per the Apex Court’s Judgement of 1992 on Mandal report by applying Para 95 of the Apex Court’s Judgement and Article 16(1) of Indian Constitution; by this the gap between the Government and people will also minimize to the maximum and this will work as one of the confidence building measures (CBMs) among the people.
The delegation demanded creamy layer for the OSCs in J&K State is only 4.5 lakh since 2008 whereas it has been enhanced twice by the Central Government now it is 8 lakh for the Central Government Order of Sept. 2017. Chief Minister was reminded of the letter sent to her by the Union on 28-08-2017 for the enhancement to 8 lakh at the earliest.
The delegation said non-implementation of Article-50 (6) of the J&K Constitution till date in which Governor has the power to nominate eight MLC seats who should be purely non-political and out of which three OBC MLCs should be nominated; shows that J&K Constitution is also not implemented in the State.
So in the absence of the implementation of J&K Constitution and Indian Constitution’ how one can claim that natural flow of justice is being allowed. The Chief Minister was asked to make a system in which poor people should never suffer.
