Ajit Singh, Davinder restrained from interfering in functioning of AJKTWA

Court directs for maintaining status quo

JAMMU, Nov 6: 3rd Civil Subordinate Judge (Special Excise Mobile Magistrate Jammu) Brij Raj Singh has restrained Ajit Singh and Davinder Choudhary from interfering in the functioning of All J&K Transport Welfare Association (AJKTWA) in any manner. Moreover, the parties have been directed to maintain status quo as on date with regard to chairmanship of the Association.
The order has been passed in a suit for permanent prohibitory injunction filed by All J&K Transport Welfare Association through its elected/nominated Chairman Karan Singh Wazir seeking directions for restraining Ajit Singh and Davinder Choudhary, their agents, assignees and other persons associated with them from interfering in any manner in the smooth and effective functioning of Association.
Further, the Association prayed for preventing the defendants from laying any claim over the chairmanship of the Association or from posing as the Chairman or any member of All J&K Transport Welfare Association. Moreover, the plaintiff prayed for preventing the defendants from making any statements or representation or press conferences directly or indirectly or even by implication that could mislead the public or authorities regarding their status or authority as present Chairman or any other member relating to All J&K Transport Welfare Association.
After hearing counsels for the plaintiff/applicant, the court issued notice to the defendants and in the meanwhile in order to avoid multiplicity of proceedings, directed the parties to maintain status quo as on date with regard to the chairmanship of the Association.
“Further, till next date of hearing, Ajit Singh and Davinder Choudhary are restrained from interfering in the functioning of plaintiff association in any manner whatsoever”, the court said, adding “the defendants are also restrained from making press conferences or any representations which are prejudicial to the interests and rights of the plaintiff association till next date of hearing”.
