Alleged militant acquitted for want of evidence

JAMMU, May 27: Principal Sessions Judge Bhaderwah, M K Sharma has acquitted alleged militant of Lashkar-e-Jabbar namely Abdul Gani, son of Ali Mohammad of Gandoh, as there was not even an iota of evidence to connect the accused with the commission of offence.
According to the case, on the night of June 29, 2003 the alleged militant along with other terrorists killed one Mastoora Bano at village Sanwara. Accordingly, a case was registered under Sections 302/458 RPC and 7/27 Arms Act at Police Station Gandoh and after completion of the investigation challan was presented in the court of law.
After hearing both the sides, Principal Sessions Judge Bhaderwah, M K Sharma observed, “to prove the allegations the prosecution cited as many as 19 witnesses. Out of these witnesses, prosecution examined 12 witnesses”, adding “the edifice of the prosecution case rests on direct as well as indirect evidence but there is not even an iota of evidence to connect the accused with the commission of offence of which the accused is charged”.
With these observations, court acquitted the accused of the charges and directed that he should be released forthwith provided he was not required in any other case.
