Amend State Act before holding BDC elections: MPEJ

JAMMU, Sept 7: Movement for Peace, Equality & Justice (MPEJ), have expressed dismay and concern over reports of holding of election for the office of Chairman BDC without making suitable amendment in the State Panchayati Raj Act (PAC) 1989.
The MPEJ members, Ram Singh Chouhan and Kuldeep Kumar Rao said that as per State Panchayati Raj Act 1989 amended up to June 2010 as also amended up to April 2011, read rule 28 of said Act, every Block Development Council shall have a Chairman who shall be a person qualified to be elected as Panch and as per rule 42-A of said Act, any person may nominated himself as a candidate for election of Panch or Sarpanch of a Halqa Panchayati if his/her name is included in the electoral roll of such Halqa Panchayati but in the said Act as amended up to March, 2016, rule 28 provides that “every Block Development Council shall have a Chairperson who shall be a Sarpanch or Panch in any Halqa Panchayati of that Block”.
They said the time has come that a suitable amendment is made in the J&K State Panchayati Raj Act that any person, whose name is entered in the electoral roll of that Block, can nominate his/her name for office of Chairperson of the BDCs or DDPBs. This will, in real term, strengthen the true spirit of democracy at the grass root level and prevent a sort of proxy candidates, who simply loyal to their political masters quite ready to dance to their whims and tunes.
