JAMMU, June 23: Special Judge Anti-Corruption Jammu SC Katal today set aside the order of attachment drawn by the Investigating Officer (IO) of the Anti-Corruption Bureau (ACB) for attachment of the property of Dheeraj Pargal son of Rakesh Pargal, a former official of Food, Civil Supplies and Consumer Affairs Department.
“The court is of the considered view that the designated authority has confirmed the order passed by the Investigation Officer in mechanical manner. No opportunity of being heard was provided to the owner of the property i.e. Dheeraj Pargal. As such the impugned order is not sustainable in the eye of law,’’ the Judge observed after listening to all parties in the case.
He said the case is still under investigation and Section 8(C) Sub Section (1) Prevention of Corruption Act empowers this court either to confirm or revoke that attachment or pass such an order, which is proper.
“The order of attachment drawn by the Investigating Officer and confirmed by the designated authority is hereby set aside but at the same time the appellants are directed not to sell, part with, encumber or otherwise dispose of the attached property initially for a period for a period of one year or till the investigation is complete or the fresh order of attachment is drawn whichever happens earlier, thereafter with the prior permission of the Director ACB or this court’’ the Judge said.
