Anticorruption Court rejects closure report against cops

JAMMU, Oct 18: Additional Sessions Judge Anticorruption Doda Amarjeet Singh Langeh today rejected the closure report filed by Doda Police against cops who were allegedly involved in corrupt practices.
“The FIR in question basically was registered pursuant to the preliminary enquiry conducted by the then Additional SP (Operation) Doda. In-explicably, he has not been associated with investigation by the Investigating Officer. Similarly, Investigating Officer did not choose to associate Vinay Kumar, the then Additional Superintendent of Police, Doda with investigation either-who charge-sheeted Sgct Pardeep Kumar and Follower Narinder Singh in departmental enquiry with allegation that they received Rs 50,500 from Farooq Ahmed, Mohd Ramzan, Gulam Nabi Malik and others when they were going to Kashmir Via Nag Mandi near Basant Ghar Dessa along with 86 bovines”, the court said.
“The association of these two police officers with investigation would not only have given vital clues to Investigating Officer but would also have helped him a great deal to un-ravel the truth. It needs no emphasis that to conduct fair, proper and un-questionable investigation-is the solemn obligation of an Investigating Officer”, the court said.
“Interestingly, Farooq Ahmed, Mohd Ramzan and Gulam Nabi, the alleged bovine smugglers whose statements under Section 164-A of CrPC were recorded -did not depose anything except that they have no knowledge about the occurrence”, the court said, adding “they did not even insinuate that Sgct Pardeep Kumar and Follower Narinder Singh ever created any hurdle for bovine smugglers and thus earned a retaliation from them”.
“The enduring assumption by Investigating Officer that police officials have been falsely implicated by bovine smugglers- thus is a perverse conclusion based on fiction propounded by him without foundational basis”, the court said, adding “the conclusion drawn by Investigating Officer in this closure report is overwhelmingly perverse, profoundly deficient and dis- proportionately obsessed with fictional assumption that Sgct Pardeep Kumar and Follower Narinder Singh have been falsely implicated in this case”.
Accordingly, court declined to accept the closure report and returned the same to Senior Superintendent of Police, Doda for further investigation in accordance with law with direction that investigation in the case be completed and report submitted within three months from today.
