LEH, Dec 18: The Apex body of the People’s Movement for 6th Schedule for Ladakh took strong exception to the statement made by Ladakh MP Jamyang Tsering Namgyal in the Parliament on December 15, demanding an amendment in the LAHDC Act 1997 to confer a safeguard to Ladakh on the lines of 6th schedule.

Addressing a press conference here today, the Apex body member and former Minister Chering Dorjey flanked by Anjuman Moin-Ul-Islam president Dr Abdul Qayum and Anjuman Imamiya vice president Sheikh Nazir and other Apex members said that MP’s recent safeguard demand is made on the direction of BJP high command because BJP high command endorsed the MP’s statement soon after.
“We are demanding safeguard for Ladakh on the base of Indian constitution whereas Ladakh MP demanded empowering Hill Council on the lines of 6th or 5th schedule which is totally wrong and misleading statement because LAHDC Act does not fall under the Constitution and people need to understand the difference between these two and we know what is right or wrong” said Chering, adding that it was well thought plan to dilute our demand.
Chering said the MP should realize that an amendment of LAHDC Act, a statutory provision, cannot be a substitute for a robust constitutional provision like the 6th schedule. The Constitutional bodies derive their powers from the Constitution whereas statutory bodies are established through Acts of Parliament or Assemblies and hence subject to changes and modifications, he asserted.
“The 6th schedule has the flexibility to adopt constitutional provisions and laws as per need of a scheduled area. JTN should have known that the LAHDC Act itself was drawn on the lines of 6th schedule but it lacks the essence, powers and the constitutional provisions of the 6th schedule,” Chering said, adding, the Apex body has taken this unbecoming statement of Jamyang Tsering Namgyal very seriously and even unkindly and has decided to hit the roads if such anti-people moves are made at the behest of enemies of Ladakh.
