Application filed for impleadment in Shri Krishna Virajman case

Jammu, Sept 11: Several civil suits have been filed in the court of civil Judge, senior division, Mathura for a decree of declaration to the effect that 13.37 acres of land situated at Katra Keshav Dev, Mathura city, is vested with deity Bhagwan Shri Krishnaji Virajman Mandir, Shri Krishna Janmasthan, Mathura.
Subsequently, on 26.05.2023 the High Court of Judicature at Allahabad in Transfer Application [C] No.88/2023, had stated, “let the District Judge, Mathura prepare a list of all such cases of similar nature involving the subject matter and touching upon its periphery, expressly or by implication include particulars of such cases along with record be forwarded to this Court within two weeks and the same shall stand transferred to this Court in exercise of suo motu powers of this Court”.
Meanwhile, the Supreme Court in SLP NO.14275/2023 filed by Committee of Management Trust of Shahi Masjid Idgah has called for details from the Registrar of High Court pertaining to civil suits filed for same relief.
Advocate on Record, Nar Hari Singh has now filed an application for impleadment on behalf of Naresh Kumar Yadav, who despite being original Plaintiff No.2 in Original Civil Suit no.423/2023 had not been arraigned as party in the SLP. The application while supporting the order passed by the High Court of Allahabad on 26. 05. 2023 has contended that the same has been rightly passed taking into consideration the proposal of section 24 1B of CPC, as well as the issue of interpretation of Places of Worship Act, several constitutional provisions, such as article 25, 26, 300 .
