PULWAMA, Nov 20: Challenging Prime Minister Narendra Modi to appoint any person or a person from abroad to discuss Article 370 with him, PDP MP Muzaffar Hussain Beig retorted that he would convince them that Indian Parliament, J&K Assembly, Centre and State Governments cannot abrogate this article.
Beig said this while talking to media persons after the local MLA and PDP candidate for Pulwama, Mohammad Khalil Bandh submitted his nomination papers.
“Notwithstanding anything in the fore-going provisions of this article, the President may by public notification declare that this article should cease to be operative or shall be operative only with such exceptions and modifications and from such date as be laid specified provided that the recommendation of the Constituent Assembly of the Jammu and Kashmir State referred to in clause 2 shall be necessary before the President issues such a notification,” read Beig from a law book quoting section 3 of the article.
He also said that Constituent Assembly on July 14,1954 passed a resolution in which it stated that the article should continue and it became a decision taken unanimously.
“The Constituent Assembly was then dissolved in 1956. Even Supreme Court has given six verdicts in which they have said that nobody can change this article,” said Beig while narrating the immunity that Article 370 has got.
The PDP leader said he was astonished that National Conference had made Article 370 a political issue and have so far promoted themselves as its sole preservers. He even expressed surprise over the statement of Mufti Mohamamd Syed that this article can be abrogated by J&K Assembly.
“I do not know why PDP patron Mufti Syed said this but the fact is that this Article cannot be abrogated,” he said.
While answering a question on Indianisation of Kashmir, Beig said that PDP was not against Indianisation but is against communalization that is being promoted by the party and Rashtriya Swayamsevak Sangh should come clean on it.
