SRINAGAR, May 7: A local court today directed to the Government to attach the properties of 7 persons accused in 2012 BOPEE scam and also asked the concerned district Magistrates to attach the immovable property of those persons who have already been declared as proclaimed offenders by the court.
These orders were passed by the Special Judge Anti-Corruption, Srinagar, Mohan Lal Manhas, after considering the application moved by the Crime Branch under Section 88 of CrPC for attachment of the properties of these seven accused.
Those whose properties are to be attached include Mohammad Amin Ganai (teacher in Zone Anantnag) son of Mohammad Ramzan Ganaie of Chee Anantnag; Abdul Majeed Mir (Pharmacist in Block Larnoo Kojernag) son of Sonaullah of Wandevalgam; Fida Hussain Lone (Statistical Assistant CMO’s office Anantnag) son of Mohammad Yousuf Lone of Kanelwan; Mohammad Amin Mir (DFO social forestry Kupwara) son of Habib Ullah Mir of Gulbarg Colony Hyderpora; Hilal Ahmad Shokli son of Mohammad Abdullah Shokli of Kralteng Anantnag; Mushtaq Ahmad Kanu son of Mohammad Abdullah of Anantnag and Mushtaq Ahmad Dar (AEE in USHP 2nd Kangan) son of Sonaullah of Sandoo, Achabal.
The court has earlier directed that the proclamation should be publically affixed on a conspicuous place in Mohalla, town and village as well as on their homes and residential houses in which the absconding accused ordinarily reside. “Despite that they have chosen to remain in hiding and did not surrender before this court,” it said.
The court after going through the motion of Crime Branch observed: “This court has reason to believe that the accused persons declared as proclaimed offenders by its earlier order have failed to surrender before this court. Therefore, this court has no option but to proceed with the attachment of the properties of 7 accused persons.”
The court further directed Chief Accounts Officer, Anantnag, to attach an amount of Rs. 2, 12,547 and Rs. 1, 18,816 as GP fund of accused Mohammad Amin Ganaie (teacher) and Fida Hussain Lone, respectively.
It also directed the warrants of attachment along with revenue records shall be forthwith sent to the executing officers for execution and further directed them to execute court order without fail and submit the compliance report of execution by or before May 29.
