Bail denied in ATM theft case

JAMMU, Feb 4: Principal Sessions Judge Jammu VC Koul today rejected the bail application of one Vijay Kumar, son of Babu Ram of Doda, who was allegedly involved in ATM theft case.
According to the police case, on 04.01.2019 Ravinder Singh, Branch Head, J&K Bank, Gurha Singhu and ATM incharge Ashish Bakshi lodged a report with the Police Station stating therein that on the intervening night of 3rd & 4th of January 2019 there was theft of their onsite ATM situated at Gurha Singhu Jammu by some unknown suspects.
On the receipt of this report case FIR No 03/2019 for offences punishable under Sections 457/380 RPC was registered and the investigation commenced. During investigation some suspects namely Amir Hussain Wagay, Amir Bashir Butt, Junaid Bashir Butt,Mehraj Din, Mohd Yousaf Khan, Umer Akbar Malik and Adil Hussain Lone were apprehended under Section 54 CrPC and enquiry was made from them.
During enquiry all the accused admitted the crime and further submitted that on the day of occurrence besides them two more persons Vijay Kumar Sharma and Naem Khan were also involved in the commission of offence. An amount of Rs11,90,000 was recovered and seized by the police and amount of Rs 2,08,200 is yet to be recovered from the accused.
After hearing both the sides in length, court observed, “if such incidents are not dealt with proper ways it would give encouragement to such elements of criminal mind and larger society is bound to suffer”.
Accordingly, court rejected the bail application.
