Bail denied in fake appointment scam

JAMMU, Dec 24: Chief Judicial Magistrate (CJM) Jammu Amarjeet Singh Langeh has rejected the bail application of one Harmeet Singh of Pulwama, who was arrested by the Nowabad Police Station in fake appointment scam.
According to the police case, FIR No. 190/2021 for offence under Section 420 of IPC came to be registered against petitioner in the backdrop of allegations that he received an amount of Rs 4 lakh from complainant and his friend against assurance that he would provide them job of driver in NHPC office at Jammu.
The petitioner was arrested on 14.12.2021 and during his personal search a fake Aadhar Card, fake PDD I-Card carrying his photograph with fake name and address, some cheques, 03 ATM Cards and a mobile phone were recovered. Besides, a copy of document (fake appointment letter) was also allegedly recovered from petitioner purported to have been issued from office of Chief Engineer NHPC, Regional office, Jammu wherein sanction for appointment of 14 individuals including complainant seems to have been granted/approved for Class-IVth/driver post.
The evidence collected during investigation as on date would explicitly show that petitioner made fraudulent job offer and collected money not only from complainant but from others also thus duped them of their money.
After hearing APP Kuldeep Kumar Bhat for the UT whereas Advocate Rafiq Mir for the petitioner, the court observed, “what is un-settling is that despite having collected vital evidence like forged appointment order, fake identity card etc- investigating agency does not seem to have shown keenness to further dig out wider manifestations of case in hand including antecedents of petitioner and patronage that he may have in perpetuation of alleged racket of providing fake appointment orders as alleged in the case”.
“Let copy of this order shall go to SSP Jammu for information and necessary action in this regard. Thus having regard to the nature of accusation, evidence in support thereof, influence of accused, quantum of punishment that offences in question do carry, fear of tampering with prosecution evidence and witnesses and larger interest of public or state, I am of the considered opinion that no case is made out by petitioner for grant of bail at this stage. This application therefore has no merit and is dismissed as such”, the CJM said.
