JAMMU, May 3: Principal Sessions Judge Udhampur Haq Nawaz Zargar today rejected the bail application of two narco smugglers Mohd Javed and Amrej Iqbal , who were arrested with over 38.570 kilograms of poppy straw by Chenani Police on 13.03.2023.
After hearing Public Prosecutor Koshal Kotwal for the police, Principal Sessions Judge observed, “release of accused person at this stage, during investigation, is fraught with the danger of destroying and disturbing social fabrics, which cannot be allowed.”
“No one can be allowed to play with the lives of others who have committed no crime. There is every possibility of repeating the same offence by the accused person. So far as liberty of a person is concerned, the same can be curtailed under due process of law. The paramount consideration is to put a halt in illegal sale and transportation of narcotics substances like poppy straw, charas and heroine etc”, the court said.
Court further observed, “having regard to the nature of the offences committed, quantity of contraband items recovered and the stage of investigation, which is still under progress and Challan is yet to be produced before the court of law, the accused persons does not deserve concession of bail at this stage, as the same may severely hamper the investigation process.”
“In such heinous offences bail cannot be claimed as a matter of right. No case of exceptional mitigating circumstances is made out for exercising discretion of bail in favour of accused persons”, the court said while rejecting the bail applications.
