JAMMU, Mar 18: 1st Additional Sessions Judge Jammu YP Kotwal has rejected the bail applications of Kuldeep Kumar, son of Bodh Raj, Vicky Kumar, son of Gkunjali and Bittu Ram, son of Rattan Ram, all residents of Bhagwani Jindrah, who were facing trial in murder case.
After hearing APP Ajay Singh Manhas for the State, the court observed, “charge for commission of murder has been framed against the accused-applicants and till date such charge has not been altered, nor same can be altered at this stage, so prima-facie presumption continues that accused have committed the offence of murder”.
“Moreover, counsel for the accused-applicants is not justified that the evidence of hostile witnesses has to be read as a whole. It is possible that an accused can be convicted on the basis of evidence of hostile witnesses, if their evidence supports the prosecution case coupled with other evidence, which has been brought on record or may be brought on record. But this exercise of appreciating the evidence of hostile witnesses with the other evidence brought on record cannot be undertaken in the application for grant of bail”, the court further said.
