Bail denied to 4 in minor boy kidnapping case

JAMMU, June 29: In the much publicized minor boy kidnapping case, Principal Sessions Judge Samba MK Sharma has rejected the bail applications of four accused persons.
They are Dheeraj Singh, son of Jodh Singh, Angrez Singh, son of Kanshi Ram, Baliat Singh, son of Chuni Lal, all the residents of Udhampur and Balbir Singh, son of Magar Singh of Doda.
After hearing Advocate Munish Choudhary for the applicant whereas CPO Samba Harminder Singh for the State, the court observed, “the petitioners/accused have been arrested by the police in FIR No. 06/2019 for the commission of offences punishable under Sections 364/384/347/147/120-B RPC, 3/25 Arms Act and 4/6 POCSV Act”, adding “during the period of kidnapping, the petitioners/accused committed penetrative sexual assault upon the victim”.
“The investigation is in progress. The witnesses in their statements have stated about the act done by the petitioners/accused.  At this stage, I am of the opinion that the accusation against the petitioners/accused is prima facie true. Therefore, there is a statutory bar for grant of bail to the petitioners/accused”, Principal Sessions Judge said while rejecting the bail application.
