Bail denied to 4 persons booked for unlawful activities

SRINAGAR, July 17: Special Judge (Designated Court under NIA) Anantnag Khalil Ahmad Choudhary has denied bail to four persons, who have been booked under Unlawful Activities (Prevention) Act.
All the four persons namely Aijaz Ahmad Sofi, son of Ab Rehman, Aaqib Fayaz Makroo, son of Fayaz Ahmad Makroo, Adil Ahmad Dar, son of Bashir Ahmad Dar and Asif Ismail Malik, son of Mohd Ismail Malik, all the residents of Bijbehara were arrested under Unlawful Activities (Prevention) Act after several posters of HM outfit were recovered from their possession from two different places.
Through the medium of these posters, accused were busy in instigating the young generation for joining the anti-national activities.
After hearing both the cases separately, the court observed, “after perusal of the police report filed in terms of Section 173 CrPC, prosecution objections and argument of APP, it is clear that there are materials establishing the involvement of the accused in the commission of offence”.
“Charge is yet to be framed against the accused. Statements of important witnesses are required before taking into consideration the bail plea of the accused as such admission of accused on bail at this stage will hamper the trial of the case and there is every apprehension of winning over of witnesses by the accused/applicants”, the court further said, adding “further there is also every apprehension that they may flee from the clutches of the law and repeat the offence”.
“On over all analysis of the matter, I am of the considered opinion that applicants/accused have failed to establish a reasonable and cogent ground for grant of bail at this stage and as such in view of the preceding analysis, there appears to be no merit and substance in the bail application of the applicants/accused”, the court said while rejecting the bail applications.
