Bail denied to accused booked under NDPSA

JAMMU, Nov 26: Principal Sessions Judge Samba Mohd Akram Chowdhary has rejected the bail application of Karamit Ali, who has been booked by Bari Brahamana Police under NDPSA.
After hearing both the sides, the court observed, “the quantity of contraband recovered from the applicant falls in intermediate quantity therefore bar of Section 37 NDPS Act is not applicable to the instant case”.
“The offence of which the applicant has been accused carries punishment of 10 years imprisonment and fine of Rs 1 lakh. Given to the severity of punishment, the offence is serious in nature. Otherwise also the menace of trade and use of narcotic drugs and psychotropic substance has become alarming to society in general and young generation in particular”, the court further observed.
With these observations, court rejected the bail application.
