JAMMU, Aug 3: Principal Sessions Judge Reasi Kamlesh Pandita today rejected the bail application of alleged bovine smuggler and upheld the order of CJM Reasi.
While rejecting the bail application of Abdul Majid, son of Mohd Hanif of Miran Sahib, Jammu, the court observed, “in a civilized society a crime disturbs orderliness. It affects the peaceful life of the society. An individual can enjoy his liberty which is definitely of paramount value but he cannot be a law unto himself”.
“This court cannot lose the site of the criminal antecedents of the accused who is involved in other four FIRs for different offences including attempt to murder. Therefore, the law expects the judiciary to be alert while admitting the plea of these kind of accused persons to be at large and therefore the emphasis is on exercise of discretion judiciously and not in a whimsical manner”, Principal Sessions Judge said.
“In case he is released on bail there is likelihood of his committing yet another offence of like nature”, the court said.
