JAMMU, Nov 19: City Judge Jammu Pooja Raina today rejected the bail application of Mohammad Yasin and Abdul Shukur, both residents of Burma who were arrested by the police under Human Trafficking Act.
According to the police case, the accused persons namely Mohd Yasin and Abdul Shukur have been arrested in connection with FIR No 342/2022 for the commission of offences punishable under Sections 370 IPC, 14 Foreigner Act, 5/7 the Specified Bank Notes (Cessation of Liabilities) Act 2017 and on the disclosure of accused, three victims namely Asmida, daughter of Rashid Ahmed, Sufairah Begum, daughter of Shamas-UI-Alam and Amina Begum, daughter of Mohd Yousaf were recovered.
After hearing APP Arvind Rathore for the police whereas Advocate Anwar Saleem for the applicants, the court observed, “the offence under Section 370 IPC deals with trafficking of persons and is grave and heinous in nature. Section 370 (3) IPC is punishable with rigorous imprisonment for a term which shall not be less than ten years, but which may extend to imprisonment for life”.
“The investigation of the case is still in progress. The applicant as stated by the prosecution is a foreign national and offence under Section 14 Foreigner Act is also alleged against the applicant. Therefore, there is a possibility of accused fleeing from the justice and repeating the offence”, the court said, adding “it has come in the investigation that applicant is holding Rs. 2.33 lacs demonetized notes which is punishable under Section 5 & 7 of the Specified Bank notes (Cessation of Liabilities) Act 2017 which amounts to an economic offence which is grave against the society as well as nation”.
Accordingly, court rejected the bail application.
