JAMMU, Feb 25: Principal Sessions Judge Udhampur ML Manhas has rejected the bail application of Ajay Kumar, who was involved in a rape case.
“The accused is facing trial for the commission of offences under Sections 376/506 RPC and the case is at the stage of final arguments”, the court observed, adding “this is a case against the society at large and enlargement of applicant/accused on bail at this stage is sure to shake the confidence of people”.
“The trial of the case is nearing completion and there is every apprehension that accused may jump over the bail or thwart the process of justice”, the court further said, adding “father of accused and other family members can participate in the solemnization of marriage of brother of accused. There is no requirement of any rituals to be performed by the accused”.
“The mere fact that accused is real brother of Sanjay Kumar whose marriage is going to be solemnized on 24.02.2020 to 26.02.2020, by itself, is not a ground for enlargement of accused on temporary bail who is indicted in heinous offence of rape”, the court said while rejecting the bail application.
