Fake recruitment scam

SRINAGAR, Dec 6: Special Judge Anticorruption Kashmir C L Bavoria has rejected for the second time bail plea of Mohammad Yaqoob Bhat, Senior Assistant in Advocate General’s office, who was arrested by the Crime Branch in alleged fake recruitment scam.
After hearing both the sides, the Special Judge observed, “the allegations against the petitioner are serious, grave and incriminating in nature and demonstrate his unprofessional conduct, unbecoming of a public servant with the eye on minting public money”.
“From the evidence collected by the prosecution till date as reveals from police report & CD file, there are genuine reasonable grounds that petitioner has committed offences as referred in FIR. Therefore having considered the same in the light of the judicial pronouncement, the incriminating material that has come fore against the petitioner during investigation, the stage is not right to grant bail in favour of the petitioner”, the court said.
“The investigation in the case is in its embryonic stage and various facts are required to be investigated. The other persons/officials who conspired with the accused to defraud the candidates by swindling huge amount of money are still at large and the involvement of some influential in part of the criminal conspiracy with the accused, the investigation qua their role is going on”, the court said, adding “the concession of bail at this stage shall undeniably prejudice and obstruct the further course of investigation as material witnesses being influenced with, cannot be ruled out”.
With these observations, the court rejected the bail application.
