Bail denied under POCSO Act

JAMMU, Aug 19: Principal Sessions Judge Reasi Kamlesh Pandita has rejected the bail application of one Joginder Kumar, who has been booked under POCSO Act.
After hearing both the sides, the court observed, “the charge-sheet has already been filed from which it appears that there are reasonable grounds for believing that the accusations against the accused person are prima facie true, therefore, accused does not deserve to be bailed out”.
“Moreover, the accused person has tried to outrage the modesty of a minor female victim who also happens to be his close relative. Moreover, the offence alleged to have been committed by the accused person is very much against the ethos of our culture and against the interest of the public at large”, the court said, adding “any sexual assault upon a girl child is termed as most heinous and dastardly acts having social, psychological, physical and emotional repercussions on the life and prospects of a victim”.
“The new legislation has been enacted with an object to deal with an iron fist on the offenders due to the ever increasing intensity of incidents of sexual violence against the children/minors. It is also duty upon the courts to fill the link with the objectives of the new legislation called POCSO, therefore, in the facts and circumstances of the case the bail application filed by the accused person is outrightly rejected”, the court said.
