Bail rejected in deadly assault on police party

JAMMU, Mar 8: Munsiff Bishnah Ananta Raina has rejected the bail application of accused persons involved in deadly assault on police party, including then SHO Bishnah.
As per the case FIR, police party headed by SHO Police Station Bishnah was performing duty near Partap Singh Poora and found that about ten persons carrying cattle in a suspicious manner. When police party inquired from them about the permission, the accused persons assaulted the cops with sharp edged weapons in which SHO Police Station Bishnah received multiple head injuries and other officers were also got injured. The accused persons had also pelted stones on police party in which a Government vehicle was damaged.
On this, a case under FIR Number 24/2021, under Section 307, 353, 332, 336, 427, 188, 147, 148 and 149 IPC and 4/25 Arms Act was registered at Police Station Bishnah.
During the course of investigation, police team led by Incharge SHO Bishnah Inspector Anil Choudhary under the supervision of SDPO RS Pura Shabir Khan arrested nine accused identified as Farooq Ali alias Bamboo, Mohammad Younis, Alarm Hussain, Manshu Ali, Mohammad Baru, Fatman Ali, Saraj Din, Shah Din and Zakir Hussain.
The accused, through their counsel, had submitted before the court that they were falsely implicated by the police in a false and frivolous case as such they are entitled for bail. On the other side, Assistant Public Prosecutor Pawan Preet Singh resisted the bail application on the ground that accused were involved in a non bailable and heinous offence.
Court after hearing both the sides at length, observed that the investigation of the case is still in the infancy stage in which the statement of the injured are yet to be recorded who are still under treatment.
“While granting bail, Court has to consider the stage of investigation, gravity of offence, nature and severity of punishment and in this case accused persons had brutally assaulted the police personnel who were performing their duty as such this Court is not inclined to grant bail for the fair investigation of the case,” said the court.
