SRINAGAR, Apr 5: The High Court today issued bailable warrants against Director Health Services Kashmir for securing his presence before court for not implementing the judgment.
Division Bench of Justice Sanjeev Kumar and Justice Puneet Gupta issued bailable warrants against the Director in the amount of Rs 10, 000 which the court said will be executed by SSP Srinagar.
Court said on December, 14 2022, four weeks’ last and final opportunity was granted to file complete compliance of the Judgment.
It was further made clear that in case the judgment is not fully complied with in letter and spirit, the Director, Health Services, Kashmir would appear in person on the next date of hearing.
Court recorded that neither the compliance report is filed, nor the Director, Health Services, Kashmir, is present. He appears to be in complete defiance of orders passed by this Court.
Court said the non-appearance of his counsel does not absolve the Director, Health Services, Kashmir, to appear in person.
“In this situation, this Court is left with no option, but to secure presence of Director Health Services, Kashmir, through bailable warrant in the amount of Rs. 10,000 to be executed by Senior Superintendent of Police, Srinagar”, Court directed.
Director is under contempt for defiance of judgment whereby he was directed to redress grievance of petitioner for taking his land for construction of Primary Health Centre in Sholipora Budgam in the year 1988.
