Bedi Comm rules out foul play in NC worker’s death

JAMMU, Dec 22: The one-man Justice (Retired) H S Bedi Commission, probing the custodial death of National Conference worker Haji Mohammad Syed Yousuf, has ruled out any foul play in the incident that took place last year.
The 96-page report of Justice Bedi Commission was submitted to State Law Secretary G H Tantray here today, an official spokesman said.
Justice Bedi submitted the report to Mr Tantray at 10 am in his office.
Law and Parliamentary Affairs Minister Ali Mohammad Sagar told the Excelsior that the report would be placed before the Cabinet for discussion as and when the Cabinet meets.
“It was the Cabinet, which had set up the Commission and the report would be discussed and debated by it”, Mr Sagar said.
Contents of Bedi Commission report were similar as reported exclusively by the Excelsior few days back and pleaded by Senior Additional Advocate General Gaurav Pachnanda.
On a cumulative assessment of the evidence on record, the Commission has found that the death of Yousuf was caused by myocardial infarction or a heart attack and that no suspicious circumstances can be spelt out.
The Government this afternoon released excerpts of the report of the Commission.
Yousuf was handed over to the IG, Crime Branch, by Chief Minister Omar Abdullah on September 29 last year from the CM’s camp office after he allegedly admitted to taking money from two National Conference workers for getting them favours from the State Government. He died a day later.
Medical tests showed that Yousuf died of cardiac arrest and that there were no external injuries on his body.
The State Government had on November 18 last year appointed the retired Supreme Court Judge as the head of the Commission to probe the death of 61-year-old Yousuf in police custody.
The Commission observed that “the evidence also reveals that Yousuf had received proper treatment while in the hospital”.
While referring to a Supreme Court judgment in the D K Basu case, the Commission has observed that DSP Bashir Ahmad Ganai has admitted that he had not himself conveyed the information about the arrest and detention of Yousuf to his associates or relatives but had passed on this duty to Munshi Nazir Ahmad.
“DSP Bashir Ahmad Ganai and Munshi Nazir Ahmad are, therefore, held liable of having failed to discharge their duty as per law,” the Commission said in the report.
The Justice Bedi Commission was asked to complete its probe within six weeks. However, the term of the Commission was extended from time-to-time. It had been constituted on November 18, 2011 and its extended term was due to end on December 28, 2012.
The Commission held its hearings on 22 days. Seventeen people, including Chief Minister Omar Abdullah and Minister of State for Home Nasir Aslam Wani, had filed affidavits before the panel.
The panel had recorded statement of 21 persons and perused various documents during its course of enquiry.
