Bhim seeks intervention of President on fate of J&K detainees

JAMMU, Mar 3: Prof Bhim Singh, Chief Patron of J&K National Panthers Party & Senior Advocate, Supreme Court of India has expressed strong resentment over the latest draconian commands by the Union Govt to suppress the law made by the Ruler of Jammu & Kashmir, Maharaja Hari Singh in 1927 to reserve Civil Rights for the Jammu & Kashmir residents which were protected by the Constituent Assembly in the Constitution for the permanent residents of Jammu & Kashmir. The NPP Supremo who has been elected four times for the Bar Association of Supreme Court of India, in his communication to the law makers in India said that the Constituent Assembly of India had categorically accepted the local laws made by the rulers of Jammu & Kashmir as part of the Fundamental Rights for all the citizens of India including that of Jammu & Kashmir.
Secondly the Govt. of India which is taking care of Jammu & Kashmir under President’s Rule has no authority to transfer the detainees from Jammu & Kashmir to any prison outside the State of J&K.
Prof Singh has also urged the President of India to seek the opinion of Supreme Court of India if the so-called Public Safety Act, enacted by the J&K Assembly, in 1978 is valid anymore.
He pleaded that after removal of Article 35A, the State made laws in connection with Fundamental Rights stand abolished with effect from 5th August, 2019, the day J&K was deprived of statehood itself.
NPP Supremo urged the President to convene an urgent meeting of Constitutional experts with Attorney General of India to give advice on the legal issues as to whether the citizens of India in J&K could be detained without trial for unlimited period and if those dtained under PSA or under NSA could be kept in detention without any trial for more than three months.
Prof Bhim who is also Executive Chairman of State Legal Aid Committee, J&K, announced that  PIL (writ petition) will be moved before the Supreme Court of India, as soon as he will get an opportunity to reach Delhi.
The submission to the President of India on behalf of all those who stand for preservation of civil liberties in J&K is that the present approach to abolish exclusive rights of the citizens of India in J&K guaranteed to them since 1927 by Maharaja Hari Singh will not be permitted by the people and by the Constitution which have been protected by the Constitution of India.
