JAMMU, Dec 4: A book titled “Damages, Expert Evidence and Valuation in Commercial Disputes in India” edited by Senior Advocate Gaurav Pachnanda and Kartikey Mahajan, Partner, Khaitan & Co has been published by Thomson Reuters.
The book launched at the Auditorium of the Delhi High Court serves as a complete guide for legal practitioners on general principles of damages, expert evidence and valuation. The book, being the first of its kind, amalgamates the principles of damages and experts’ methods of calculation of damages with legal and case analysis.
Supreme Court Judges—Justice Sanjay Kishan Kaul, Justice K V Vishwanathan, Acting Chief Justice of High Court of Delhi Justice Manmohan and Justice Vibhu Bakhru (Judge, High Court of Delhi) were the guests of honour at the book launch event.
Speaking on the occasion, the Judges highlighted the relevance of the topics covered by the book in today’s commercial law jurisprudence. While tracing the evolution of commercial law itself, they enlightened and enriched the audience with their erudite expertise on the subject. Appreciating the vast sea of knowledge that the book offers, they welcomed this as a step to aide the practice of commercial law in the country in more ways than one.
Several distinguished luminaries from the legal field from across the world including India, United Kingdom and Singapore attended the book lunch function. Various Judges of the Supreme Court of India and the High Courts of India were also present. Some of these dignitaries included Justice Sanjay Karol (Judge, Supreme Court of India), Justice Hemant Gupta (Former Judge, Supreme Court), Justice Pratibha Singh (Judge, Delhi High Court), Justice Naveen Chawla (Judge, Delhi High Court), Justice Sanjeev Narula (Judge, Delhi High Court), Justice Permod Kohli (Former Chief Justice, Sikkim High Court), Justice V K Gupta (Former Chief Justice, Jharkhand High Court), Justice Gita Mittal (Former Chief Justice, Jammu and Kashmir High Court), Justice Murlidhar (Former Chief Justice, Orissa High Court).
Many Senior Advocates including Amit Sibal, Sidharth Luthra, Gourab Banerji, Maninder Singh, Huzefa Ahmadi, Basava Prabhu Patil, Paras Kuhad and Nakul Dewan also attended the event. Several other partners and associates of leading law firms and noted legal practitioners from several jurisdictions were also present.
Pachnanda, in his opening remarks, emphasised on the need for restatement of the literature on principles of damages and filling the gap in literature regarding valuation and proof of damages, specifically in complex commercial contracts.
He threw light on the three-year process that ultimately culminated in the form of this book, which started from brainstorming ideas and identifying issues in commercial disputes across the globe (on damages, experts and valuation) with his co-editor, to reaching out to various judges, practitioners, and subject-matter experts for contributing chapters and finally editing and amalgamating all the chapters into the final product.
The book has numerous chapters, written by around 70 authors.
The authors have recognised the lacunae in the available literature and have drawn from their own experience to provide much needed analysis of crucial issues. The authors and the editors of the book hope this book serves as the beginning of a long-term commitment to demystify the complexities of commercial disputes arising across the globe.
